Does a container need a building permit? Slovakia
In Slovakia the governing measure is built-up area. A container whose built-up area stays within 50 m2 and whose height stays under 5 m falls into the simplified route and is handled as a notification. Above that line the full building-permit procedure applies. The basis is Zákon č. 25/2025 Z. z. Stavebný zákon a o zmene a doplnení niektorých zákonov (stavebný zákon), § 18 ods. 3, in the version of 2025-11-01. Do you need a permit or is a notification enough?
A minor structure under § 2(4)(a) to (c) is notified to the building authority. It is not exempt. Anything over 50 m2 or over 5 m is no longer a minor structure and needs a building-intent decision.

What to watch out for
- The 25 m2 figure in wide circulation comes from Annex 2(1)(b) of act 201/2022 Z. z. That act was repealed by act 25/2025 Z. z. The Slov-Lex record states it verbatim: „Predpis bol zrušený predpisom 25/2025 Z. z.“ The older § 139b attribution belongs to act 50/1976 Zb., two acts back.
- The act defines firm connection to the ground exhaustively in § 2(1): a fixed foundation, fastening by machine parts or a weld, anchoring by piles, ground screws or cables, connection to the technical infrastructure networks, or placement underground. A container that meets none of these five is not a building under this act.
- The act sets no fixed time limit for temporary structures generally. § 2(16) says the duration is limited by purpose, by construction, or by the building authority’s decision. The explicit five-year limit applies only to an information structure, not to every temporary structure. That is why the comparison table shows no temporary-use figure for Slovakia.
